There are several misconceptions about creating a will. Some people say you only need a hand-written note. Other people say to buy a form from the Internet. But these recommendations do not acknowledge that your needs, wishes and plans are unique. Not only may a fill-in-the-blank form fail to address your particular need, you may not even know from looking online whether it is a legitimate form or accepted in the state of New Jersey.

Probate Administration

Upon your death, there are several things that must be done. A copy of your legal will must be filed with the courts. An executor or administrator of the will must be appointed to follow the directions left in your estate plan. Your debts must be paid, and then your assets distributed to your beneficiaries. Additionally, during the administration of your will, your estate may go through probate court to determine if your directives were properly implemented.
