First Offense Conviction
The court may offer leniency to a first offender, however, the sentences commonly applied to offenders upon their first DWI (drunk driving) conviction:
- Up to 30 days in jail
- $250-$400 fines ($300-$500 if your BAC is .10 or above)
- 3 months driver's license suspension (7 months-1 year if your BAC is .10 or higher)
- $525 minimum other DWI fees
- $1,000 for 3 years as an auto insurance surcharge
- Attend an intoxicated driver resource center for education for 2 days/6 hours a day
Second Offense Conviction
In New Jersey, like most of the rest of the country, the penalties for a second offense drunk driving conviction escalate drastically:
- Up to 90 days in jail
- $500-$1000 fines
- 2 years driver's license suspension
- $525 minimum other DWI fees
- $1,000 for 3 years as an auto insurance surcharge
- 30 days of community service
The following fees are applied in all drunk driving convictions:
- Surcharge for the drunk driving enforcement fund - $100
- Motor Vehicle Restoration fee - $100
- Violent Crimes Compensation fee - $100
- Intoxicated Driver Program Fee - $100
- State and Municipality fee - $100
Also, it is important to note that the court may order you to have an ignition interlock device installed on your vehicle. This would be done at your own expense once the suspension of your driver's license has ended.
